1. Introduction
These Terms & Conditions (“Terms”) govern your use of this website (the “Site”) and your purchase of products from Discovery (the “Brand”, “we”, “us”, “our”). By accessing or using the Site and placing an order, you agree to these Terms in full. If you do not agree with any part of these Terms, you must not use the Site or place an order.
2. Who we are
Discovery is a brand under the company Kling Trading LLC (or its UAE entity). Products sold via the Site or authorised retailers are genuine and subject to the warranties and policies provided by us.
3. Use of the Site
3.1 You represent and warrant you are at least 18 years old and legally capable of entering into binding contracts.
3.2 You must provide accurate, current and complete information when registering and placing orders.
3.3 You must not misuse the Site by transmitting harmful code, viruses or attempting unauthorized access.
3.4 We reserve the right to suspend or terminate your access to the Site for violation of these Terms.
4. Orders and Contract Formation
4.1 All orders placed by you are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason (including unavailability, errors in pricing or description).
4.2 A contract between you and us is formed only when we send you a confirmation email that your order has been accepted.
4.3 The price of a product will be that advertised on the Site at the time you place the order, except in cases of manifest error. We are not obliged to provide a product at the incorrect price even if your order is accepted.
4.4 Payment is required before dispatch unless otherwise agreed.
5. Pricing, Payment & VAT
5.1 All prices on the Site are shown in AED and include UAE VAT (unless otherwise indicated).
5.2 Payment may be made using the methods displayed on checkout. We are not responsible for any additional banking charges or currency conversion fees.
5.3 Title to the products remains with us until full payment has been received (if applicable).
6. Delivery & Risk
6.1 We will deliver products to the address you specify at checkout, within the geographic region we serve (currently UAE, unless otherwise stated).
6.2 Estimated delivery times are provided for guidance only and are not guaranteed. We are not liable for delays due to courier, customs, weather, or other circumstances beyond our control.
6.3 Risk of loss or damage to products passes to you on delivery. Responsibility for checking condition of goods on arrival is yours.
7. Returns & Refunds
7.1 Unless your purchase is faulty, damaged, or not as described, returns are subject to our Returns & Exchanges Policy (see separate page).
7.2 Refunds will be processed in accordance with that policy.
7.3 We may deduct reasonable shipping, handling or restocking costs if applicable (as set out in the Returns & Exchanges Policy).
8. Warranty & After-Sales Service
8.1 Products sold via our Site are subject to the standard warranty described on our Warranty & Repair page.
8.2 The warranty covers defects in materials or workmanship and is separate from your statutory rights.
8.3 We provide paid repair services once the warranty period has expired.
8.4 The warranty does not cover product misuse, normal wear and tear, damage from negligent handling or modifications by unauthorized persons.
9. Limitation of Liability
9.1 To the fullest extent permitted by law, our total liability to you under or in connection with any order or these Terms shall not exceed the price you paid for the product.
9.2 We are not liable for any indirect or consequential loss or damage, including loss of profit, data or delay.
9.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence or any other liability that cannot legally be limited or excluded under UAE law.
10. Intellectual Property
10.1 All copyright, trademarks and other intellectual property rights in the Site and materials published on it are owned by us or our licensors.
10.2 You may view or download extracts only for your personal non-commercial use. Any other use (including reproduction, modification, distribution) is prohibited without our prior written consent.
11. Privacy & Cookies
Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.
12. Force Majeure
We will not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay is caused by events beyond our reasonable control (for example: natural disasters, war, terrorism, pandemic, government action, strikes, transport or telecommunication failures).
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, and the courts of the relevant Emirate shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.
14. Changes to Terms
We may revise these Terms at any time by updating this page. The revised version will take effect when published. Your continued use of the Site after such changes indicates your acceptance of the updated Terms.
15. Entire Agreement
These Terms, together with our Privacy Policy, Returns & Exchanges Policy and Warranty & Repair policy, constitute the entire agreement between you and us in relation to your use of the Site and purchase of products, and supersede any prior agreements.
